Assumption of Risk & Waiver of Liability
By booking a court and using the facilities at Dinky Promise, I acknowledge and agree to the following:
1. Assumption of Risk
I understand that participating in pickleball and other physical activities involves inherent risks, including but not limited to muscle strains, sprains, fractures, concussions, heat-related illness, and other bodily injuries. I voluntarily assume all risks associated with my participation in any activities at the venue.
2. Waiver of Liability for Injuries
I hereby release, waive, and discharge Dinky Promise, its owners, operators, employees, agents, and affiliates from any and all liability, claims, demands, or causes of action arising out of or related to any injury, illness, or death that may occur as a result of my use of the venue's facilities, equipment, or participation in any activities, regardless of whether such injury is caused by negligence or otherwise.
3. Lost or Stolen Belongings
Dinky Promise is not responsible for any lost, stolen, or damaged personal belongings brought onto the premises. Players are advised to keep their valuables secured at all times. The venue does not provide safekeeping services and assumes no liability for any personal property left unattended.
4. Medical Acknowledgment
I confirm that I am physically fit to participate in pickleball and related activities. I understand that Dinky Promise does not provide medical personnel on-site and that I am solely responsible for my own health and well-being during my visit.
5. Venue Rules & Conduct
I agree to follow all posted venue rules, staff instructions, and safety guidelines. I understand that failure to comply may result in removal from the premises without refund.
By checking the waiver checkbox and proceeding with the booking, I confirm that I have read, understood, and agree to all the terms stated above. This waiver applies to all current and future visits to Dinky Promise.
